Our Terms
These conditions have been developed in line with the Housing Grants Construction Regeneration Act, 1996 and are considered to be fair and reasonable. By placing your order and signing the Contract Acceptance document, you will be deemed to have accepted that these conditions are fair and reasonable and that the contract has been made upon and is subject to them.
Validity of Quotes:
Quotes are given along with the drawings and are only valid for a period of three months; in every case quotations will be recalculated after that time and adjusted when necessary.
Design variations after contract acceptance:
You will be kept fully informed of the progress of construction while on site. Small changes and details can be accommodated at the time of construction. The sizes in quotations and plans are approximate and should not be scaled or relied upon for precise measurements. They are for guidance only and may vary as construction takes place.
Dedication to tree care:
BlueForest is a member of both the Arboricultural Association and the International Society of Arboriculture and is dedicated to the correct methods of tree care. The need to create a structure that is in harmony with the tree and its surroundings is of utmost importance in BlueForest TreeHouse design. Care will be taken at all times to pay particular attention to the overall health of the tree(s) and surrounding vegetation.
Care and Maintenance:
BlueForest uses materials of the highest quality and methods of construction for long-term use and therefore expects its Tree Houses to be able to be used for years to come.
Tree Houses are outdoor products and therefore require maintenance and regular inspection, as the natural products used are susceptible to certain changes in the environment. All the timber used in construction is carefully pre-treated for rot and decay to British Standards, being pressure impregnated with a water-based preservative, which is safe to handle and greatly extends the service life of the timber.
Every spring and autumn the Tree House must be completely inspected and any items requiring attention should be corrected. Every two years the entire structure must be treated with a recognized timber preservative. BlueForest offer a comprehensive annual maintenance check, which covers all necessary areas. Our commitment to quality, covers workmanship and material faults, but does not cover regular maintenance requirements or problems encountered when this maintenance is not carried out.
Safety Measures:
Whilst we make every effort to incorporate safety aspects in the designs and construction, Tree Houses cannot be guaranteed to be totally safe. BlueForest accepts no responsibility for any accidents that may occur.
Responsibility:
Our Tree Houses are designed to withstand normal weather conditions including, wind, rain and snow. However, no responsibility at all is accepted to cover damage, of the tree house, tree or surrounding trees, caused by abnormal conditions i.e. extremely high winds, gales or hurricanes.
Planning Issues:
Although BlueForest will strive to give the best advice possible, all planning issues including, but not solely, Planning Permission and Tree Preservation Orders, are the full and complete responsibility of the client. If the proposed Tree House or Tree Deck is within site of neighbours we would always advise that you inform them of your intentions and if required show them the TreeHouse concept plans and drawings.
Copyright:
Any drawings, plans, elevations or illustrations contained relating to this or future quotations, or created during any re-visions are protected by Copyright ? BlueForest Ltd; and may not be reproduced, utilized for construction purposes by yourself or other parties and may not be passed on to a third party without the express permission of BlueForest. BlueForest Ltd cannot be held responsible for any accidents or injuries caused if these plans are used without permission. BlueForest reserves the right to use photographs taken during and after construction in marketing activity, however will not disclose clients name and address unless permission is given.
Employees:
BlueForest employs installers that are fully trained and skilled in all aspects of Tree House construction. Site area is out of bounds for the duration of construction, except for Blue Forest employees and those with express permission to enter the site area.
Health and Safety:
We implement a full Health and Safety Policy. Staff procedures are laid out in a manual, which may be viewed upon request. As an important part of our safety procedures we set out a clearly identified 'Caution / Danger' area around the site of construction.
Insurance:
BlueForest Ltd carries full Public, Product and Employees Liability, which is available to be viewed upon request.
Terms of Trading:
- Deposit of 40% on placing order, signing contract acceptance document and confirmation of construction dates
- Stage payment of 30% due approximately halfway through TreeHouse construction.
- 30% within 10 days of completion.
All materials remain the property of BlueForest Ltd until full payment is made, these may be recovered in the case of a dispute.
Procedures for settling disputes:
Any claim or dispute arising out of or in connection with a contract for the services of BlueForest Ltd shall be under the jurisdiction of The English Courts and governed by English Law irrespective of the origin of products and location of the contracting parties. |
